Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Caden Materials, LLC (“Caden Tile,” “we,” “us,” or “our”). They apply when you use cadentile.com, create an account, or place an order (together, the “Services”). By using the Services or placing an order, you agree to these Terms and to our Privacy Policy.

Please read section 13 carefully. It requires you and us to resolve most disputes through individual arbitration instead of in court, and waives class actions and jury trials. You can opt out within 30 days, as explained there.

1. Eligibility and Accounts

You must be at least 18 years old to buy from us. You are responsible for keeping your account login private and for activity under your account. Tell us right away if you think your account has been used without your permission.

2. Products, Colors, and Natural Variation

We try to show products accurately, but colors on screens, photos, and samples can differ from the material you receive. Tile, glass, and especially natural stone vary in color, shade, veining, texture, and size from piece to piece and from lot to lot. This variation is normal and is not a defect. Please order samples and enough material for your project from a single lot. Product information, specifications, and availability may change without notice.

3. Prices, Orders, and Payment

• Prices are in U.S. dollars and do not include taxes or shipping unless stated.
• Your order is an offer to buy. We accept it when we confirm it or ship it. We may decline or cancel any order, including for suspected fraud, stock issues, or errors in price or product information. If we cancel after you have paid, we will refund you in full.
• You authorize us and our payment processors to charge your payment method for your order, taxes, and shipping.

4. Shipping, Delivery, and Damage

Shipping methods, time frames, and delivery details are described on our Shipping page. Delivery dates are estimates. If we cannot ship within the stated time, we will contact you with a revised date and you may cancel for a full refund. Please inspect your delivery when it arrives. Report any shipping damage within 48 hours of delivery, with photos and a note on the carrier's delivery receipt, so we can arrange a replacement or refund.

5. Returns and Refunds

Returns are governed by our Return Policy, including its 30-day return window, 30% restocking fee, and exclusions for samples and custom orders. Items that arrive damaged or defective are not charged a restocking fee.

6. Custom Orders, Samples, and Services

Custom and special orders are final sale. Our 3D rendering and other services are based on the plans, measurements, and information you provide, and we are not responsible for errors in that information. Trade, referral, and rebate programs may have additional terms that we share with participants.

7. Installation and Product Information

Articles, guides, calculators, and other information on our site are general information, not professional advice. Quantity estimates are approximate. Have a qualified installer confirm your quantities, substrate, and installation method, and follow the manufacturer's installation instructions and applicable building codes. Cutting, drilling, or grinding tile and stone creates dust; use proper ventilation, dust control, and protective equipment. We do not install products and are not responsible for installation work by others.

8. Warranties

Products may be covered by a manufacturer's warranty, which we will help you pursue. Except for those warranties and any warranty that cannot be excluded by law, the Services and products are provided “as is,” and to the fullest extent permitted by law we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow these exclusions, so they may not apply to you.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, labor or installation costs, or project delays, arising from the Services or products. Our total liability for any claim is limited to the amount you paid for the product or service that the claim is about. Some states do not allow these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

10. Use of the Site

Site content, including text, photos, designs, logos, and software, belongs to us or our licensors and is protected by intellectual property laws. You may use the site for your own shopping and projects. You may not copy or resell site content, scrape or overload the site, interfere with its security, or use it for anything unlawful.

11. Third-Party Links and Services

Our site links to and uses services run by others, such as brand websites, payment processors, carriers, and video players. Their terms and privacy policies apply to them, and we are not responsible for their content or practices.

12. Indemnity

If you misuse the Services or break these Terms, you agree to cover our reasonable losses and costs from claims by others that result, to the extent permitted by law.

13. Dispute Resolution and Arbitration

Try to resolve it with us first. Before starting arbitration or a court case, the person bringing the claim must send a written description of the dispute and the relief requested to hello@cadentile.com. We will both try in good faith to resolve it within 60 days.

Binding individual arbitration. If we cannot resolve it, you and we agree that any dispute arising out of or relating to these Terms, the Services, our products, our marketing, or our privacy practices will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitrator decides all issues, except that a court decides whether this section is valid, enforceable, or applies to a dispute. The Federal Arbitration Act governs this section. Fees are paid as the AAA Consumer Arbitration Rules provide. The arbitration may take place by video or phone, or in the county where you live.

Exceptions. Either party may bring an individual claim in small claims court, and either party may ask a court to stop infringement or misuse of intellectual property.

No class actions or jury trials. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding. The arbitrator may not consolidate claims or award relief to anyone other than the individual party. You and we waive any right to a jury trial. If this class-action waiver is found unenforceable for a particular claim, that claim must be decided by a court, not in arbitration.

30-day opt-out. You can opt out of this arbitration agreement by emailing hello@cadentile.com within 30 days of first accepting these Terms, with your name, the email address on your account or order, and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. Any claim not subject to arbitration will be brought in the state or federal courts for the county in California where Caden Materials, LLC has its principal place of business, and you and we consent to their jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order. Changes take effect when posted, except that changes to section 13 do not apply to disputes already pending.

16. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer your rights under these Terms without our consent. These Terms, together with the policies they reference, are the entire agreement between you and us about the Services.
